Terms of Use — Stratum Six

When we say "Stratum Six," "we," "our," or "us," we mean Stratum Six LLC, a Florida limited liability company based in Miami. When we say the "Site," we mean stratumsix.com. When we say "you," we mean anyone who visits or uses the Site, and the organization on whose behalf they act.

By using the Site, you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the Site. There may be times when we do not exercise or enforce a right or provision of these Terms; that does not mean we waive it. These Terms contain a limitation of our liability.

The Site is informational

The Site describes our firm and our services. Nothing on it is professional, legal, financial, or technical advice for your particular situation, and neither using the Site nor contacting us creates a client relationship. Any engagement is governed by a separate written agreement signed by both parties.

Acceptable use

You agree not to:

use the Site in violation of any law or regulation;
attempt to gain unauthorized access to the Site, its hosting, or related systems;
interfere with the Site's operation, including by overloading it or introducing malicious code;
access the Site by automated means in a way that ignores our robots.txt file or degrades its performance;
submit false information, impersonate another person, or send unsolicited advertising through the contact form.

What you send us

When you contact us, you confirm that the information you provide is accurate and that you are entitled to share it. Please do not send confidential or sensitive information through the contact form; if an engagement requires it, we will arrange an appropriate channel. You keep ownership of what you send, and you give us permission to use it to respond to you and to evaluate a possible engagement. We handle personal information as described in our Privacy Policy.

Copyright and content ownership

The Site and its content, including text, design, graphics, logos, and code, belong to us or our licensors and are protected by intellectual property laws. You may view the Site, share links to it, and quote brief passages with attribution. You may not otherwise copy, modify, or republish its content, or use our name or logo, without our written permission. The text of these Terms and of our Privacy Policy is available under CC BY 4.0, as noted below. Other company names that appear on the Site belong to their respective owners, and their appearance does not imply endorsement.

Links to other sites

The Site may link to websites we do not operate, such as LinkedIn. We are not responsible for their content or practices.

Disclaimer of warranties

The Site is provided "as is" and "as available." We work to keep it accurate and available, but we do not warrant that it is error-free, complete, current, or uninterrupted. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Stratum Six shall not be liable, in law or in equity, to you or to any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use of or inability to use the Site; (ii) unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party on the Site; or (iv) any other matter relating to the Site or these Terms, whether in contract, tort (including negligence), or any other theory of liability. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars.

Indemnification

If your use of the Site in violation of these Terms or the law results in a claim against us, you agree to indemnify and hold us harmless from the resulting losses, damages, and reasonable legal fees.

Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms; when we do, we will revise the date at the top of this page. Your continued use of the Site after an update means you accept the revised Terms. We may restrict access to the Site for anyone who violates these Terms.

Governing law and venue

These Terms and any dispute arising from them or from your use of the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any such dispute shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms and our Privacy Policy are the entire agreement regarding your use of the Site; any engagement for services is governed by its own written agreement.
